McOwen HomePro Services Terms and Conditions

1. Scope of Services

McOwen HomePro Services (“Contractor”) agrees to provide routine home maintenance services for the Client’s residence located at the address above. Services may include, but are not limited to:

• Water heater draining
• Refrigerator cleaning and filter replacement
• HVAC filter replacement
• Dryer vent cleaning
• Smoke detector testing
• Caulking/sealing
• Visual inspection for leaks or damage

A full list of services and frequencies will be provided in Exhibit A – Maintenance Plan, which is incorporated into this agreement.

2. Term and Renewal

This Agreement shall commence on the Effective Date and continue for a period of 12 months, unless terminated in accordance with Section 9. This Agreement automatically renews for subsequent 12-month periods, with services to be billed quarterly.

If either party wants to terminate the agreement early, they must provide written notice to the other party at least 30 days prior to the end of the current term.

3. Service Schedule

The Contractor will schedule services every 3 months, or as needed based on Client's request. The Contractor will provide at least 24 hours' notice before scheduling any service appointment.

4. Payment Terms

Payments are due within 5 days of receipt of invoice. A late fee of $25 will be charged for payments received after 10 days from the date of invoice. Payments can be made by check, credit card, or bank transfer.

If payment is not received within 30 days of due date, the Client will be considered delinquent and the Contractor may suspend services until payment is received.

5. Access to Property

The Client agrees to allow the Contractor access to their residence for the purpose of performing maintenance services. The Client shall provide a secure and safe environment for the Contractor during service appointments.

6. Warranties and Liability

The Contractor warrants that all work performed under this Agreement will be done in a workmanlike manner and with reasonable care. However, the Contractor makes no other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

In no event shall the Contractor be liable for any damages, including but not limited to consequential, punitive, or special damages, arising out of or related to this Agreement.

7. Indemnification

The Client agrees to indemnify and hold harmless the Contractor, its officers, directors, employees, and agents from any claims, demands, or liabilities arising out of or related to this Agreement.

8. Force Majeure

In the event of an emergency or natural disaster, the Contractor may suspend services until it is safe to resume work.

9. Termination

Either party may terminate this Agreement upon written notice to the other party. Upon termination, all outstanding balances shall be paid in full within 30 days of receipt of invoice.

10. Governing Law and Entire Agreement

This Agreement shall be governed by and construed in accordance with the laws of [State/Province]. Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, writings, or oral agreements.

11. Exhibit A – Maintenance Plan

The following services may be included in the McOwen HomePro Services Plan:

Initial Services: Furnace filter replacement, Clean dishwasher filter, Clean garbage disposal, Check smoke and carbon monoxide detectors (battery replacement available as add-on), Check plumbing for leaks/issues, Run water in unused spaces, Test and reset all GFCI outlets, Check electrical panel and outlets (up to 50 total), Mid-Year Deep Maintenance Services: Replace refrigerator water filter (up to 2), Clean refrigerator coils, Clean washing machine interior/drain filter, Clean dryer vent, Clean around and under appliances: Refrigerator, Oven, Washing machine, Dryer, Dishwasher (no pull-out unless requested), Water softener check, Humidifier filter replacement, Inspect and lubricate garage door parts, Clean range hood vent/filter, Additional Services Offered: Drain water heater (helps extend water heater lifespan), Annual plumbing inspection, Check all shut-off valves (plumbing & gas), Inspect attic & basement for leaks, mold, and pests, Inspect & install fire extinguishers and first aid kits (supply cost extra), Whole-home exterior inspection, including roof check, Reminders & Scheduling Support: HVAC servicing reminders, Rug cleaning scheduling, Chimney cleaning scheduling Note: This is a sample list of services. The actual services provided may vary based on the specific plan selected by the Client.

By signing below, the Client acknowledges that they have read and understood the terms and conditions of this Agreement and agree to be bound by its terms.
